Why can’t I find a workers’ compensation lawyer in Kansas?

I received a call from a former client one afternoon.

“My sister got hurt at work in Kansas, but she can’t find a lawyer. Do you know someone?”

I had a similar question a few months earlier. So why is it harder to get a workers’ compensation lawyer in Kansas than it is in Nebraska?

The short answer to the question is Nebraska has much better workers’ compensation laws than Kansas, so more lawyers are willing to take workers’ compensation cases in Nebraska than they are in Kansas.

Because of a quirk of legal history, explained more in depth here, workers’ compensation laws developed as state-based laws. Bordering states can have vastly different workers’ compensation laws –Nebraska and Kansas are a prime example

Kansas v. Nebraska: Prevailing cause vs. contributing factor

Medical causation is a crucial issue in a workers’ compensation case. Causation standards are tougher for employees in Kansas. In Kansas work duties must be a prevailing factor for an injury to be covered under their workers’ compensation act. In Nebraska work just needs to be a contributing factor to the injury. 

In Nebraska, aggravation of an old injury is routinely covered by workers’ compensation. If a work combines with personal health conditions to cause an injury, that is covered by workers’ compensation in Nebraska. In Nebraska, in most workers’ compensation cases the parties aren’t arguing over whether workers’ compensation will pay, they are arguing over how much workers’ compensation will pay.

In Kansas, there are many more arguments about whether workers’ compensation will pay because of the more difficult causation standards in their workers’ compensation law.

The practical effect of the difference in laws is that it is hard to find a lawyer willing to take a workers’ compensation case in Kansas. Some Kansas attorneys view calls about workers’ compensation cases as borderline nuisance calls.  The shortage of lawyers in Kansas willing to take workers’ compensation claims particularly hurts injured workers that are far away from metropolitan areas that require lawyer travel.

In contrast, in Nebraska, lawyers who specialize in workers’ compensation usually have significant client bases outside of Lincoln/Omaha and travel to the less populated parts of the state on a regular basis. Nebraska pays many types of injuries on a loss of earning power basis, which means that injured workers in parts of the state that are remote from population centers potentially have more valuable cases. Lawyers in Nebraska are willing to travel to represent those employees. In Kansas that distance from a population center is hurdle to a lawyer accepting a case.

Sometimes employees can get get a good outcome in a Kansas workers’ compensation case. This also isn’t to say that there aren’t good workers’ compensation lawyers in Kansas. Tough laws can make for tough lawyers. But Kansas workers’ compensation laws are worse for workers than Nebraska laws, so fewer lawyers are willing to represent injured workers in Kansas than in Nebraska.

How to claim Nebraska workers’ compensation if you were hurt in or live in Kansas?

In order to bring a workers’ compensation case in Nebraska, Nebraska has to have jurisdiction over the employee and the employer. If you were hurt in or hired in Nebraska, you can bring a Nebraska workers’ compensation claim. If your employer is based in Nebraska or does business in Nebraska, your employer is subject to the Nebraska workers’ compensation act and you can bring a case in Nebraska.

Why are workers’ compensation laws better in Nebraska than in Kansas?

This is more of a political question than a legal question. Nebraska and Kansas are both conservative “red states”. I believe the difference between Nebraska and Kansas when it comes to workers’ compensation, and other issues, can be explained by the unique nature of Nebraska’s legislature. Nebraska is unique among the 50 states in having a one house or Unicameral legislature. More important are legislative rules in Nebraska that require a broad consensus to enact legislation. Nebraska also elects legislators on a non-partisan basis which further re-enforces the need for consensus to pass laws. These rules are further enforced by norms and customs within the Unicameral that make it difficult to push through legislation without broad support.

The current Governor has pushed to change those rules, but has not been able to bend the Unicameral to his will.

While big business interests will gripe about workers’ compensation in Nebraska, Nebraska has a business-friendly litigation climate in general which blunts the pressure to reduce workers’ compensation benefits in Nebraska. This is particularly true as workers’ compensation claims continue to decline. In short, there doesn’t seem to be the political will — at this time — to push for making Nebraska’s workers’ compensation laws like Kansas workers’ compensation laws.

Kansas court holds adoption of AMA 6th violates due process

The Kansas Supreme Court undid one small part of Sam Brownback’s legacy

The Kansas Supreme Court ruled on Friday that adoption of the American Medical Association Guides to Permanent Impairment, Sixth Edition (AMA Sixth) to pay permanent injuries under their workers’ compensation act violated constitutional rights to due process because it gave injured workers an inadequate remedy for work injuries.

The decision in Johnson v. US Food Service came on the heels of a recent Oklahoma decision that upheld the constitutionality of the AMA Sixth in that state’s workers’ compensation law. Injured workers in Kansas were likely helped by the Kansas applying heightened scrutiny in assessing a due process violation rather than applying what amounts to rational basis scrutiny like the Oklahoma court did in upholding their use of the AMA Sixth.

The Kansas court also seemed to be persuaded by findings of fact and legislative history about the problems with the AMA Sixth in how it compensates work injuries. The court was particularly persuaded by findings that the AMA Sixth lead to lower impairment ratings because it measured impairment based on inability to do general life activities rather than activities related to working. The Kansas decision throwing out the use of the AMA 6th will likely be persuasive to trial courts in other states when deciding whether impairment under the AMA 6th sufficiently compensates injured workers. 

The decision was also premised on the fact that injured workers give up the right to a trial by jury to pursue a tort claim against the employers to receive workers’ compensation benefits. According to the Kansas court, compensating employees under the AMA 6th when combined with other recent changes to Kansas workers’ compensation law meant that employees were giving up too much in exchange for not being able to sue their employers and have a trial by jury.

Last month, I posted “Appellate courts aren’t going to save workers’ compensation.” Maybe I was too pessimistic in that assessment considering Johnson case. But a closer reading of the Johnson case shows my thesis is still sound. The Kansas court went through an exhaustive list of anti-worker reforms made by the Kansas legislature in 2011 and 2013 to that state’s workers’ compensation laws.  With the exception of using the AMA 6th, those anti-worker reforms are still law in Kansas. I hope the decision in Johnson will help advocates for injured workers rollback other negative changes made to workers’ compensation law in Kansas. But the changes to Kansas’ workers’ compensation laws came through the political arena and victories in the political arena are the only sure way to insure fair compensation for injured workers in Kansas and in the rest of the country.

I agree with the outcome and most of the reasoning supporting the Johnson decision. But I disagree with the court’s literary flourish arguing that injured workers aren’t heard in adminisatsrive hearings or bench  trials. The majority of my court room experience comes in what amount to bench trials in the Nebraska Workers’ Compensation Court. In my experience the injured worker gets to tell their story and — just as important – management witnesses are forced to answer for their treatment of injured workers as it relates to issues being tried. At least in Nebraska, trials in worrkers’ compensation cases can address that emotional need for justice outside fiancial compensation. But for most people, the finanical outcome of a case is more important than the process used to obtain the outcome.

Thomas Robinson, editor of the leading treatise on workers’ compensation law, stated the Kansas court’s focus on assigning fault for an injury misses the point of workers’ compensation which means defined compensation for a work injury regardless of fault. I agree with this point. I’ve written about the role of fault in the suppodedly no fault world of workers’ compnesation. I will be interested to read Robinson’s take on fault and workers’ compensation.

Kansas Supreme Court Decides Whether Undocumented Immigrants Are Entitled To Workers’ Compensation Benefits

Are undocumented immigrants entitled to workers’ compensation benefits in Nebraska?

Recently, the Kansas Supreme Court examined the same question that has been previously answered by the Nebraska courts.

The short answer is, yes. Undocumented workers are entitled to most workers’ compensation benefits under Nebraska law. The exception is that undocumented immigrants are not entitled to the vocational rehabilitation benefit because the worker is not legally permitted to be in the country.

To some people, Nebraska law and this Kansas decision make sense, but unfortunately many people believe that undocumented workers should not be entitled to work comp. This argument fails for the following reasons:

  1. If someone is injured at work and needs to seek medical treatment, it must be paid somehow. If it is not paid by workers’ compensation (even though the injury occurred at work), the cost of that treatment will be passed to the medical providers and the general-public. The employer will get away scot-free while everyone else would share the burden of mounting healthcare costs.
  2. Employers should not get a benefit of hiring undocumented workers over citizens or documented workers. As stated above, if the employer does not have to pay workers’ compensation benefits for an injured, undocumented worker, the employer will be encouraged to hire undocumented workers over others as cost-savings. It is the employer’s responsibility to hire documented workers, but if it means the cost-savings of not having to pay work comp benefits, you can bet that employer will try to hire undocumented workers over others.
  3. Similar to the previous reason, employers would be discouraged from taking safety measures to ensure the safety of its workers if it knows that it won’t be required to pay for undocumented workers’ injuries. This would make the workplace more dangerous for all workers.
  4. Regardless of citizenship, an injured worker has an inalienable right to be treated for work injuries simply based on the fact that his/her job has made money for that employer. This is the whole point of the workers’ compensation system: to provide a quick (relatively speaking) and efficient way to get medical treatment and compensation for any worker that is injured while making money for that employer. Without the beneficiary of the work that cause the injury being required to pay work comp, this burden would inevitably be pushed to tax payers in one form or another. In other words, taxpayers should certainly want undocumented immigrants to get workers’ compensation benefits.

OSHA Investigates October Incident; Also Focuses Efforts on ‘High-Hazard Manufacturing Industries’

The U.S. Labor Department’s Occupational Safety and Health Administration recently highlighted two news releases that are related to or will affect workplace safety, workers’ injuries, and workers’ compensation in both Iowa and Nebraska. These two states are in OSHA’s Region 7, along with Kansas and Missouri.

OSHA’s news release on Jan. 14 focused on an incident where a Nebraska worker fell more than 20 feet and died in October of last year. The worker had been employed for Custom Contracting Inc., of Lincoln, for just two weeks, according to the news release from OSHA.

There was no fall protection provided to the workers at their construction site, and “the agency also found the company failed to train workers to:

  • “Recognize fall hazards.
  • “Render first aid.
  • “Operate powered industrial vehicles.

“In addition, guard rails were not installed on open sides and ends of platforms to prevent falls, and lift trucks were found to be modified without manufacturer’s approval,” according to the website.

OSHA proposed penalties of $36,000.

“Fatal incidents like these are entirely preventable. They have tragic consequences for the victims, their families, and their communities,” said Jeff Funke, OSHA’s area director in Omaha, as quoted in the news release. “Construction industry employers must protect workers from falls, which continue to be the leading cause of worker’s death in the construction industry.”

In the second news release from OSHA that I’d like to discuss, a regional emphasis has been announced this is focusing on “high-hazard manufacturing industries” in Nebraska, Kansas and Missouri.

“The increased likelihood that workers in high-hazard manufacturing industries – such as food, furniture, fabricated metal, nonmetallic mineral, machinery and computer products – will be injured on the job is leading federal safety and health inspectors in three Midwestern states to increase its focus on industry outreach and inspections to reduce injury and illness rates,” according to the news release from OSHA.

This “region-wide emphasis program” is expected to last three months and includes “outreach and education to assist employers” to decrease hazards “and increase the probability of inspections at establishments in high-hazard industries with more than 10 employees and those that have not had a comprehensive inspection since 2011.”

Struck-by Vehicle Incidents: OSHA’s Regional Emphasis Program for Region 7

The Occupational Safety and Health Administration (OSHA), which is part of the U.S. Department of Labor, has announced via news release that it’s continuing its Regional Emphasis Program in Region 7 for struck-by vehicle incidents.

As was mentioned in a recent blog post, Region 7 includes the states of Iowa, Nebraska, Kansas and Missouri.

Here is some additional information from the news release:

Over fiscal years 2008 through March 2013, “15 percent of all workplace fatalities investigated by the Kansas City Office … have involved vehicle accidents that struck employees in the workplace,” and there were 37 vehicle-related fatal incidents. The operator was the victim 43 percent of the time, while 57 percent of the time, the vehicle struck another worker. In addition, “seventy percent of the fatal incidents occurred at general industry work sites, while 24 percent happened in construction.”

Vehicles involved include “conventional vehicles, forklifts, semi-trucks and other moving industrial equipment” like cranes and yard trucks and cover the “construction, general and maritime industries.”

OSHA does inspections to follow up on complaints and referrals they get about the vehicles, and the news release also included a link that addresses struck-by hazards, which can be found here.

OSHA’s Region 7 Busy in September

The U.S. Department of Labor’s Occupational Safety and Health Administration is frequently referred to as OSHA.

OSHA’s Region 7 covers Iowa, Nebraska, Kansas and Missouri, although Iowa operates its “own OSHA-approved job safety and health programs and cover state and local government workers as well as private sector workers.” In addition, the approved program “must have standards that are identical to, or at least as effective as, the federal OSHA standards,” according to an OSHA web page. The region has had a busy month releasing the results of investigations and resulting fines, so I thought it would be interesting to make this blog post a roundup of the results, which were gleaned from OSHA news releases, found at the web page for Region 7.

Although the proposed fines unfortunately do not reflect the severity of some of the injuries, OSHA’s job is not to punish businesses for injured workers, but for unsafe working conditions. That also means that fines are often decreased or eliminated when the hazard in the workplace is fixed. However, OSHA investigating a business based on an accident can often help an injured person’s workers’ compensation case.

  1. Date and location: Sept. 2, McCool Junction, Neb.

    Proposed fine: $84,000

    Number of citations for safety violations: one repeat, two serious to Farmers’ Cooperative at its McCool Junction fertilizer plant

    Details: A 73-year-old worker died from injuries after falling while loading a tanker truck on May 7, according to OSHA’s news release. Citations were related to lack of fall protection, lack of guard rails, and not providing railing on stairways.

  2. Date and location: Sept. 2, Kansas City, Mo.

    Damages paid to whistleblower: $12,000: $2,000 compensatory and $10,000 punitive

    Law violated: Federal Railroad Safety Act by Farmers’ Cooperative

    Details: A railroad conductor at the Murray Yard complex was disciplined in retaliation after a doctor’s appointment in November 2013 where the doctor told him to stay out of work for the rest of the day because of a personal illness, according to OSHA’s news release. Although the worker notified a supervisor about the doctor’s treatment plan, “the company then accused the employee of violating its attendance policy and subsequently disciplined the employee.” In addition to paying damages, the company must “remove disciplinary information from the employee’s personnel record and provide whistleblower rights information to its employees.”

  3. Date and location: Sept. 22, Omaha, Neb.

    Proposed fine: $133,900

    Number of citations for safety violations: three repeat and three serious, including confined space safety regulations, to Watco Companies of Pittsburg, Kan., a business that specializes in rail car repairs and has 30 employees in Omaha

    Details: A worker “reported suffering from respiratory inflammation after performing welding work inside a rail car in Omaha,” according to OSHA’s news release. An investigation in March was launched after the Nebraska Department of Labor Workers’ Compensation Division notified OSHA via a report of the illness. Repeat violations were “for failure to implement training, procedures and practices for safe entry into these spaces, including the company’s failure to evaluate for hazards, and to provide workers with communication devices or implement measures to prevent unauthorized entry.” Previous citations that made these repeat happened in Texas in 2013. “Serious violations were cited for failure to provide administrative and engineering controls to reduce damaging noise exposure, electrical hazards and lack of atmospheric controls in confined spaces.”

  4. Date and location: Sept. 25, Holdrege, Neb.

    Proposed fine: $14,000

    Number of citations for safety violations: two serious: “for failing to train workers in the recognition of unsafe conditions and to teach them how to access emergency medical services from a job site,” according to OSHA’s news release. The company is Van Kirk Sand and Gravel, operating as Van Kirk Brothers Contracting, which is based in Sutton, Neb.

    Details: One worker died and one worker was hurt after getting hit “by an excavator bucket while installing stormwater drainage in a trench … in Holdrege on July 17.” The inspection by OSHA “found that one of the employees sustained puncture wounds from the bucket after it disconnected from the excavator and rolled into the trench from a height of about 4 feet.” That worker died, and the other worker “suffered contusions and abrasions in the incident and has since returned to work.”

  5. Date and location: Sept. 25, Wichita, Kan.

    Damages paid to whistleblower: $261,787 for back wages and damages; and also reinstatement to their job and removing references to the disciplinary action from the employee’s record

    Law violated: Surface Transportation Assistance Act by Stericycle Inc. of Lake Forest, Ill., which specializes in biohazard waste disposal

    Details: “An investigation found the company wrongfully terminated a transportation supervisor at its Wichita terminal because the worker raised safety concerns after a driver was instructed to pull a trailer without a valid license plate,” according to the OSHA news release. When the employee was fired in September 2012, it was because of his status as a whistleblower. “It was determined that his protected activity was a contributing factor in the company’s decision to terminate his employment on Sept. 14, 2012, in direct violation of STAA.”

In addition to investigating unsafe working conditions, OSHA also works with nonprofits, businesses and industries to promote safety and accident prevention, which is what the remainder of the news releases in September are about.

  • On Sept. 3, OSHA announced that it is forming an alliance with the Heartland Workers Center of Omaha. This effort will “provide HWC staff, immigrant workers and others with education, guidance and access to training resources on protecting the health and safety of workers,” according to the OSHA news release. This includes promoting workers’ rights, how to make an OSHA complaint, what employers’ responsibilities are under the Occupational Safety and Health Act, and providing Spanish-language safety and health training.
  • On Sept. 16, OSHA announced that it will work with Holder Construction Group to keep workers safe during the building of a data center called the Oasis project in Omaha, “which will include a chiller plant, administrative areas and supporting mechanical, electrical and plumbing rooms,” according to OSHA’s news release. The estimated 180 tradesmen who will construct the building, along with their employers, will learn “about hazards construction workers face daily on the job, including fall, electrical, caught-in and struck-by hazards.” In addition to other details, “all contractors and subcontractors on the project will be required to have specific written safety and health programs in place and attend meetings before major work takes place.”
  • Finally, on Sept. 25, OSHA announced in a news release that it was National Farm Safety and Health Week Sept. 21-27. Although the way workers’ compensation is handled when it comes to agriculture varies from state to state, ag is a dangerous industry. The news release includes both statistics and resources with many links for ag workers and their loved ones and also employers. The 2014 theme was “Safety Counts: Protecting What Matters,” according to the OSHA news release. “With a fatality rate of 22.2 for every 100,000 full-time workers, agriculture recorded the highest fatality rate of any industry sector,” in 2013. Issues include “awareness of confined space, farm equipment, grain handling … work-related lung diseases, heat exposure, noise-induced hearing loss, struck-by and fall hazards, skin diseases and certain cancers associated with chemical use and prolonged sun exposure.”

While it would be great if OSHA didn’t have to exist because workplaces were safe for employees, it is helpful to see both proactive steps taken to make workplaces safe and also businesses being held accountable when workers are injured because businesses or job sites are unsafe in Region 7.
